In this Privacy Policy we explain how we use your personal data obtained via the online shop https://www.kupzegarek.com/ (“Shop”). The Controller shall ensure that, for his/her part, he/she takes special care to protect the rights and interests of persons whose personal data is processed in connection with the use of the Store. The data collected by the Controller shall be processed in accordance with current legislation and exclusively for the purposes specified.

Whenever a capitalised term is used in the body of this Privacy Policy, it shall be understood as follows:

  • Cookies - means IT data, in particular small text files, recorded and stored on the user's terminal equipment, in particular such as computer, phone, tablet. Cookies record and store certain information, which can then be accessed by IT systems for specific purposes. They are most often used to optimise the use of the website as well as to collect statistical data to identify how the website is used.
  • Controller's Cookies - means cookies placed by the Controller, related to the Controller's operation of the website.

However, due to the nature of the information collected, it is not possible for the Controller to attribute it to a specific user.
  • Processing of personal data - means an operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
  • Profiling - means any form of automated processing of personal data which involves the use of personal data to evaluate certain personal factors of an individual, in particular to analyse or predict aspects relating to that individual's performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
  • GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

5. On what grounds do we process your data?

We use the data we collect primarily to be able to contact you by email or telephone, for the purposes of processing and fulfilling your order, including handling complaints and refunds in the event of withdrawal, and for marketing and promoting our own services and products. The data will be processed in order to:

  • a) conclude and perform the contract (fulfilment of the order placed and provision of electronic services) - forename and surname, company, address of residence, billing data, payment data, e-mail address, telephone number, Tax Identification Number (NIP) - on the basis of Article 6(1)(b) of the GDPR;
  • b) add opinions about products - forename, surname - on the basis of Article 6(1)(b) of the GDPR;
  • c) marketing activities through electronic means of distance communication - forename, surname, e-mail address, telephone number - on the basis of Article 6(1)(a) of the GDPR;
  • d) customer service, contact by electronic means or through a contact form - forename, surname, e-mail address, telephone number - on the basis of Art. 6(1)(a) of the GDPR;
  • e) asserting or defending against claims - forename, surname, company, e-mail address, telephone number, address of residence, NIP number - on the basis of Art. 6(1)(a) of the GDPR;
  • f) profiling of personal data in order to tailor offers and advertising of products or services to your personal preferences, behaviours and use of the website - on the basis of Art. 6(1)(a) of the GDPR.

You have the right to choose whether and to what extent you want to use our services and share information about yourself. Providing your personal data is voluntary, although failure to provide personal data necessary to complete a product order may prevent its proper execution.

The data we collect is used first of all to be able to contact you by e-mail or telephone, to process your orders, including to examine complaints and return benefits if the agreement is rescinded, as well as for marketing purposes and for promotion of our services and products.

9. How can I transfer my data?

You are entitled to receive the data we are processing upon your consent or in performance of our agreement. The data will be automatically sent to your or to a third party in a standard, machine-readable format. If you want to have this data transmitted directly to another party responsible for it, this will be carried out to the extent technically achievable.

10. How long do we process your personal data?

We process your data for as long as necessary to maintain your user account, carry out your orders, provide post-sale services, and handle complaints. In addition, we may retain your data within a scope needed to claim overdue payments or to take necessary actions in connection with violation of generally applicable law or of the Shop rules. In the above cases, your personal data can also be kept after your account has been deleted, however for a period not being longer than necessary to achieve the objectives given above, and this period shall not be shorter than the expiry of the limitation periods for contractual claims.

13. What other data do we process?
